As discussed in class today, your assignment (due Monday by 6:00PM) is to complete and revise the standard purchase-and-sale agreement I posted according to this morning's negotiations and to draft a supplemental memo describing any additional considerations, open questions, or revisions that should be seriously considered from the perspective of your side (either representing the buyer or seller - as you did in groups today). The main results of the negotiations today include the following: 1) Purchase Price: $245,000 2) Earnest Money: $4,000 3) 60-day inspection contingency period 4) Contingencies related to closing on prior home and mortgage terms (6% or less) 5) Closing costs: Seller See y'all on Tuesday. Since the assignment was not opening, here it is in a different format. Sorry about the confusion. Real Estate Transactions, Fall 2009 Assignment #1 Bill and Brenda Buyalot have been searching for a new home. They found just the right house, a spacious new modern ranch style house with a flat back yard that is big enough for the pool the Buyalots have always wanted. It is the first home in a new subdivision developed by Developing Country LLC (DC), a company founded by its 5 Member-Investors. In fact, it’s the original show home, but DC is now willing to open another show home if the Buyalots want to buy this one. Before buying the home, the Buyalots must sell their current home. If it sells for their asking price they should walk away with around $80,000, a very nice down payment for the new DC home. The Buyalots are both employed, and they can afford to pay $1,500 per month in mortgage payments. You’ll learn more details tomorrow when you’re asked to negotiate aspects of the deal on behalf of either the Buyalots or DC. In the meantime, please review the standard Georgia Realtors’ Puchase-and-Sale Agreement, and familiarize yourself with its terms since you will be using it as the first draft document for completion, revision and addition. |
