Law of Wills and Intestate Succession Assignment for Wednesday, September 30, 2009 1. Problem on Advancements (Handout). 2. Casebook Bottom of 163 - 165. 3. Casebook, 166 - 174 (Includes Sullivan). 4. Casebook, Bottom of 174 - Top of 188 (Read Generally). 5. Handout from Georgia Probate Notes (In Re: Hunter). The material in Item 4, dealing mostly with the UPC's Augmented Estate concept, should be read generally. The concept is very important for what it might say about the future direction of law, but you do not need to be able to execute a detailed application of the statutes. Give closer attention to the text and to Section 2-202, however. Section 2-202 deals wit the UPC's elective share formula. We actively will begin with Baird from the previous assignment. Law of Wills and Intestate Succession Thursday, September 10, 2009 and Friday, September 11, 2009 1. Casebook, Middle of Page 83 - 88. 2. UPC § 2-106. 3. UPC § 2-709. 4. Chart of the Hastings family (handout). 5. Three Statutes (handout). Statute C, obviously, is the UPC's Scheme: per capita at each generation Copies of this assignment, with the handouts, are available on the third. Remember: Representation schemes apply to lineal descendants of the decedent. Representation schemes also apply to lineal descendants of collaterals who would have taken if those collaterals has not prededeceased the decendent. Materials on representation almost always seems difficult at first. You can deal with it. Professor Claxton |

Law of Wills and Intestate Succession Assignment for Friday, August 28, 2009 1. Casebook, Pages 62 - 73. 2. Note particularly the sections from UPC, especially Section 2-103. On the surface, this assignment is rather brief and routine. In reality, it constitutes the core of the major section of the course; intestate succession. The comments to the UPC Sections (available only in your supplement) will help. Law of Wills and Intestate Succession Assignment for Wednesday, September 2, 2009 and Thursday, September 3, 2009 UPC Section 2-101, 2-102, 2-103, 2-104, 2-105, 2-106, 2-107, 2-108, 2-113, 2-114, and 2-709. You certainly are not expected to gain a full understanding of these sections now. I simply want you to read them carefully and get a general sense of their fundamental meaning. I know that 2-103, 2-106 and 2-709 will be challenges at this stage. Professor Claxton |

Law of Wills and Intestate Succession Assignment for Wednesday, August 26, 2009 and Thursday, August 27, 2009 - Casebook, Pages 940 - 943.
- Casebook, Pages 943 - 947.
- Casebook, Notes on Conservators and Guardians, Page 953.
- Casebook, Note on 957.
- Casebook, Middle of 958 - 960.
- Casebook Middle of 986 - Bottom of 994.
- Casebook, Middle of 1007 - 1009.
- Three Handouts (on table outside Room 144).
You will find that most of these materials do not deal with the passage of property at death. Instead, they deal with issues that affect any individuals toward the end of life (and sometimes earlier). These times do not represent the core of the course, but they are vital to almost all families today. Most of the first days class will focus on the handout dealing with estates. The required casebook is Estates and Trusts: Cases and Materials, 3rd ed., edited by Debris, Sterk and Leslie (Foundation Press). Buy a used book if possible. They are less expensive. The required statutory supplement is Uniform Trust and Estate Statutes, 2009-2010 edition, edited by Langbein & Waggoner (Foundation Press). You must have a new, clean, copy. Assignments will be distributed by computer. A hardcopy of each assignment will be kept in a notebook on the table outside Room 344. Whenever an assignment includes a handout, the handout will be placed on the table outside Room 344. I do not use the handout slots. Professor Claxton |
